The inaugural session of the Trust & Estates Institute took place at the 30th Annual Lavender Law Conference and Career Fair.  The Institute was designed to offer experienced trust and estate practitioners the opportunity to discuss issues affecting the LGBT community and discuss legal trends and strategies for now and in the near future. Modeled after the Family Law Institute, the Trust & Estates Institute offered high level group discourse rather than a traditional CLE lecture format, as well as an opportunity for practitioners to collaborate with a national network of experienced practitioners.

Moderated by: Joan Burda, Joan Burda Attorney at Law

This Session Will Address:
-Name and gender changes for testators and beneficiaries;
-Children-definition of child; afterborn and pretermitted heirs; stored genetic material and disposition;
-Relationship Status; married vs. unmarried; previous undissolved relationships; ownership of property and transmutation opportunities and exposure for the practitioner; common law marriage recognition; poly families/multiple parents and inheritance rights;
-Extra documents that LGBT people may still need in the Trump era

10:45am-12:15pm Session II: Updating Estate Plans and Busting Trusts

This Session Will Address:
-Separate vs joint trusts; Transmutation of Property; Previous Agreements limiting rights; i.e. pre or post nups;
-Inheritance and Bypass Trusts-should they be maintained; practical, moral, and ethical decisions of terminating trusts

-Local trainings, i.e. adult protective services; emerging statuses; elder care resources
