Disputes over the custody of children, whether between co-parents or against a child-welfare agency, are difficult to navigate in the best of circumstances. But, misinformation and misconceptions about transgender people—in general and as parents—too often prevent transgender parents from proving their fitness as parents and maintain their relationship with their children. This can taint every aspect of the legal proceeding from establishing legal parentage and child support to custody and decision-making authority. This panel will provide insight into the challenges of representing transgender parents and offer practical tips to attorneys working on these cases.
